These Terms of Service ("Terms") govern your access to and use of SykoLive Media LLC's websites, apps, live streams, games, social features, messaging tools, virtual items, and related services (collectively, the "Services"). In these Terms, "SykoLive," "we," "our," and "us" refer to SykoLive Media LLC.
By creating an account, accessing, or using the Services, you agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and any additional rules or policies we may post for specific features.
You may not use SykoLive if you are under 13 years old. If you are under the age of majority in your jurisdiction, you may use SykoLive only if permitted by applicable law and, where required, with appropriate parental or guardian involvement.
You must be at least 18 years old to purchase virtual coins, send paid gifts, access monetized creator features, receive creator earnings, request payouts, or use any other restricted financial or monetization features.
You are responsible for your account, login credentials, devices, and all activity that occurs under your account. You agree to provide accurate information, keep your information up to date, and maintain the security of your account.
You may not share your account in a way that violates our rules, impersonate another person or entity, create misleading profiles, or attempt to evade suspensions, bans, restrictions, or other enforcement actions.
SykoLive provides live streaming, social interaction, gaming, messaging, profile, gifting, premium, and community features. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, lawful use.
We may add, remove, suspend, modify, or discontinue features, content, access methods, or functionality at any time.
You are responsible for content you create, upload, stream, post, send, or otherwise make available through SykoLive, including profile information, usernames, messages, chat content, stream content, game-related content, images, videos, and other materials ("User Content").
You represent that you have the necessary rights to your User Content and that your User Content does not violate the law, these Terms, our Community Guidelines, or the rights of others.
By submitting User Content to the Services, you grant SykoLive a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, transmit, display, perform, distribute, moderate, review, and otherwise use the User Content as reasonably necessary to operate, secure, improve, and enforce the Services and our policies.
You may not use SykoLive to engage in or promote:
We may monitor, review, remove, restrict, demonetize, disable, hold, suspend, or terminate accounts, streams, chats, gifts, purchases, payout access, or other activity when we believe it is appropriate to protect users, enforce our rules, investigate abuse, comply with law, reduce risk, or protect SykoLive and the public.
Moderators, admins, automated systems, and internal review tools may be used to detect, investigate, and respond to policy violations, fraud, underage use, exploitation, chargebacks, harassment, impersonation, payment misuse, or other harmful conduct.
We are not obligated to permit, host, display, restore, monetize, or continue any content, account, feature, or payout eligibility.
Virtual coins, virtual gifts, and similar in-service digital items are licensed, limited-use digital items for use only within SykoLive. They are not bank accounts, deposits, stored value accounts, personal property, or redeemable cash balances for purchasers.
Except where required by law or expressly stated by us, virtual coin purchases, gift usage, and virtual item transactions are final once completed, spent, sent, consumed, or credited in the service.
We may set or change pricing, availability, expiration rules if any, feature access, or usage rules for virtual items at any time.
Certain rooms, streams, interactions, or features may require following a creator, sending a qualifying gift, purchasing virtual coins, or meeting other eligibility conditions. Access to these features may be limited, revoked, ended, or changed at any time.
We may restrict access to premium, private, age-restricted, monetized, or sensitive experiences for safety, legal, moderation, fraud-prevention, or operational reasons.
Creator earnings, rewards, or payout eligibility are not guaranteed. Only creators who satisfy our requirements may be eligible to request a payout or other monetized benefit.
Cash-out or payout requests are subject to our Cash-Out Policy, manual review, fraud checks, account standing, identity verification, payment processor requirements, legal compliance, tax documentation, and any additional rules we apply to protect the platform.
We may delay, reject, reverse, offset, freeze, or hold payouts or creator balances where we suspect fraud, chargebacks, refund abuse, policy violations, underage activity, moderation problems, inaccurate information, legal risk, or other platform integrity concerns.
Payments may be processed by third-party providers such as Stripe, app marketplaces, or other payment vendors. Your use of those payment services may also be subject to their terms and policies.
To the extent permitted by law, we may deduct or offset chargebacks, refunds, reversals, processing fees, fraud losses, taxes, penalties, or other losses associated with your activity, purchases, monetization, or payout activity.
You are responsible for taxes, reporting obligations, and other government charges associated with your use of the Services, purchases, earnings, or payouts, unless applicable law requires otherwise.
The Services, including our software, platform design, branding, logos, text, graphics, interfaces, features, audio, video, and related materials, are owned by SykoLive or our licensors and are protected by intellectual property and other laws.
Except as expressly permitted by us, you may not copy, modify, distribute, reverse engineer, scrape, republish, sell, lease, sublicense, or exploit any portion of the Services.
SykoLive may contain links to, integrations with, or dependencies on third-party websites, payment processors, authentication providers, hosting providers, app stores, or other services. We are not responsible for third-party services, content, policies, or availability.
We may suspend, restrict, demonetize, or terminate your access to the Services, in whole or in part, at any time, with or without notice, for violations, safety concerns, fraud risk, underage use, legal compliance, operational issues, or any other reason we reasonably determine is necessary to protect users or the platform.
Upon termination, your right to use the Services ends immediately. Certain sections of these Terms will survive termination, including sections relating to payments, virtual items, moderation, liability limits, disputes, and any obligations that by their nature should survive.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYKOLIVE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not guarantee uninterrupted service, continuous availability, successful streaming, successful delivery of messages or gifts, error-free operation, or that the Services will always be secure or free from harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYKOLIVE, ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SYKOLIVE FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SYKOLIVE, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100.00).
You agree to defend, indemnify, and hold harmless SykoLive, its affiliates, owners, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your account, your User Content, your conduct, your violation of these Terms, or your violation of any law or rights of another person or entity.
We may revise these Terms from time to time. When we do, we may update the effective date above. By continuing to use the Services after updated Terms become effective, you agree to the revised Terms.
